I leave in Calif and was sued in small claim, plaintiff didnt show case dismiss, Q. can he sue me again 4 same

I got in an accident, the owner of the track is suing me (no the driver, isnt the driver the one who is suposs to do it) the first time i went to court he didnt show up, judge dismiss the case, now he's suing me again or exactly the same can he do that. Please help thnx

    He can sue you again, but I don't think that he will prevail, because it is on the same facts for the same event as the first time, and the case was dismissed, so he lost. I don't think the judge in the second suit will look kindly on this at all, and will probably deny his suit.

    Yes, he can sue you again. A case where the plaintiff doesn't show is usually dismissed without "prejudice". This mean that if the plaintiff can show the Court that they had a good reason for not being able to attend Court, they can get a new trial.

    However, if the plaintiff shows up and loses, then the plantiff must file an appeal to try to get the Court to re-consider it's decision.

    Bottom line, the plaintif can resubmit the suit if the case was dismissed because of a no-show at Court

    I am not sure if they can or not..but what I do know is that if they continue to sue you that you can make them pay your attorney's fees....especially since the case was dumped the first time. Usually that makes them stop. It's also in your favor the first case was dismissed.
