Wrong birth date in birth certificate?

I am using January 17 as my birth date. However, when I get my birth certificate from NSO it shows I was born January 23.According to an NSO personnel, I will need the services of a lawyer to change my birth date to January 17. Is the NSO right? I asked a friend and said there's no need. Does anybody know what is the procedure in changing the birth date? I'm from the Philippines.

Update:

23rd is the birth date. The birth certificate was only recently released to me. I think if the sex is wrong or the surname is wrong, that's the time that I need to seek a lawyer.

Are you sure your birth certificate gives your birth date as the 23rd? If it's in Spanish legalese or some other hard-to-decipher form, it may be saying that the 23rd is the date the certificate was issued, and down there in the tiny type is your actual birth date. Check this out before you panic.

If you verify that the certificate actually says the 23rd, you'll have to decide if you should go through all the red tape to try to get a new certificate showing January 17th, or if you should relax to the inevitable and use the 23rd from now on, correcting any important records that may have accumulated -- Social Security, etc. etc.

It could be an issue if other documents don't match up - like if you try to get a passport or marriage licence. I had a friend who had her father's surname on her birth certificate but her Mother's maiden name on her school ID card, etc. so couldn't get her learner's permit until she turned 18 & could legally change her name. Similarly, my grandmother had problems as her father (who had possibly had a few to bring) filled in the forms that her name was James, born male. I'd contact Births, Marriages & Deaths Office & discuss your options with them - I think you should definitely try fix this.

Yes as marys.momma said. You should carefully check it. And while at it, check also your baptismal certificate if it would match.

Changing records does not only involve NSO the Court will be involved too. There will be hearings to be conducted. Time and money are the factors.

You need to go to court to change your birth date. A lawyer would know the correct procedures in which to file and apply. This is not a change that can be done without a judge's approval. Your friend probably believes that it is a simple clerical change. It is not.

  • Good luck it will take forever and you will need to seek the advice of a lawyer. I would just say my birthday is the 23rd a lot less hassle in this, and then you can have 2 birthday partys!
