BESTBUY DIABLO II DIGITAL COPY NO ACTIVATION WAS SENT TO MY E-MAIL?

At Joplin, MO BESTBUY, they're not sending out ACTIVATIONS for there digital copies of this game. The card clearly states Enter the activation code printed on your receipt. But the receipt says it'll be e-mailed too you. I waited about 2 weeks, still nothing I'ved called bestbuy been hung up on around 19 time times and waited and waited and waited I even made a ticket out to BLIZZARD and not a word came back.. It seems they're ripping people off that buy a DIGITAL COPY of this game DIABLO III... Anybody else have this happen? Its a little card you get from BESTBUY, Says BATTLE.NET FULL GAME DIGITAL COPY 59.99. Under that it says Bring card to register and receive a code on your receipt to activate a digital copy on Battle.net.... Yet I never got anything.. I was scammed.. Can I file a lawsuit over this ?
